Life On The Go With Swiss Army Knife
What is one thing that has seen wars, opened gazillions of canned beans, corned beef, soup, bottled colas, and beer, and is now sitting prettily at the New York Museum of Art? Your guess is as good as mine. It's the ever faithful Swiss Army knife.
The Soldier's Valet
Forty-four years after the last armed conflict on Swiss territory, Karl Elsener designed the first prototype of the Swiss Army knife. This creative burst of genius was triggered by his indignation that the Swiss Army was issuing German-made pocket knives to their soldiers.
His first design had a cutting blade, can opener, a punch, and a screwdriver - the perfect mechanism for soldiers who had no time for an extra baggage. Five years later, he added a spring mechanism that secured two additional cutters on both sides of the handle. What made him add a corkscrew is something worth pondering - but it was heaven sent.
The soldiers could do a lot of things with one small device - uncork a bottle of wine, whittle wood, mince onions, fix a loose screw, and clean their fingernails.
This invention soon invaded the US Army. Finding it hard to say Offiziersmesser the GI Joes called it the Swiss Army knife, and the name stuck. Today 116 years later, Elsener's invention is as multi-tasking as ever with added features such as the miniature scissors and the hair tweezers. The soldier's valet indeed marched with the times.
Is that a Swiss Army Knife?
Elsener sold his invention under the Victorinox label. Victorinox was coined from the combination of Victoria and inox, in honor of his mother Victoria and the stainless steel or inox he used for his knives.
The famous utility knife invaded the golfing greens and is now on cyber mode with the latest Cybertool 34. Is it still legal to carry a Swiss army knife for utility purposes?
I'm not carrying it to stab people or to commit any crimes - I merely use it for utility purposes. You never know when you'll need to cut some string or open a can or something, and it's quite a useful item. Is it still acceptable in the eyes of the law to carry such an item however? With increased scrutiny on knives currently, I'm a tad concerned. Also, what would happen if I was attacked by someone, and did use it to defend myself? I would like some legal clarification, please.
Tony's spot on, but I would add that, if found during a police search, they may try to confiscate it.
Although carrying the knife itself is not illegal, carrying it with the intention of using it as a weapon is. In order to make a charge against you the police officer(s) in question would have to have reasonable suspicion that you intended to use it as a weapon, and although I doubt any court would convict you without evidence of you making a threat to that effect, some police forces are told that simply having a knife is suspicious enough and may try to make a case where there isn't one.
It's very unlikely that you'll ever be stopped & searched (providing you're not doing something you shouldn't be that is), but if you are, make sure you don't accept a caution or allow the knife to be confiscated without charges being brought against you. If you allow them to confiscate it without them arresting you, it's treated as voluntary, and it will be destroyed. You will not get it back. If you are arrested and accept a caution on the understanding that you won't have to go to court, be aware that is an admission of guilt, and will stay on your criminal record permanently... quite a drag when you haven't even broken the law!
As for what would happen if you did use it defensively; legally it would be treated as a "lawful object", and providing using it was not considered "excessive force" you'd be perfectly OK to do so (of course if you're carrying with the INTENTION to use it as a defensive tool, you are breaking the law! You must INTEND to use it SOLELY for utility tasks for this to apply.). On a practical point, you'd probably do much more harm to yourself than an attacker! Swiss Army Knives are fiddly to open, don't offer much grip and and the blade doesn't lock open.... a recipe for disaster in a fight (I don't think knives are very good defensive tools anyway, but a SAK would be the worst of the lot!). It would be much more useful (and legally acceptable) to use it while closed as an impact weapon.
That said, there was a case where a women who had been pinned down to be raped managed to open and use one very effectively while the attacker was fumbling with her underwear.... so they do have some defensive capability.
